R. Kelly’s attempts to wiggle out of jail for home detention are being rejected fast by U.S. District Judge Martha M. Pacold over concerns of community threats. The disgraced R&B singer, who has been busy serving out a 30-year prison sentence after being found guilty on charges of sexually exploiting and abusing multiple women and minors, is still hanging onto dreams of overturning his conviction, but freedom couldn’t be more elusive.

In an order earlier this month, Judge Pacold explicitly stated that Kelly’s motion did not meet the factual threshold for reconsideration. “Kelly has not produced any argument or evidence, much less clear and convincing evidence challenging [the court’s previous] finding or indicating that circumstances have changed such that Kelly is no longer a flight risk or a danger to the community,” she said.

The ruling is another devastating setback for Kelly’s push for post-conviction legal relief. His team had filed an emergency motion arguing that his imprisonment was unsafe and unjust and that he should be released. But the court was unpersuaded, noting that if Kelly poses the risk alleged, it has not reduced with time and circumstances. Nonetheless, the troubled performer is not prepared to go down without a fight. A motion for a new trial is pending. In that filing, Kelly alleges extensive misconduct during the first trial. His legal team claimed that a crucial witness in the case had been bribed to change her testimony, an allegation that, if true, casts serious doubt on the trial.

Furthermore, in a shocking claim, Kelly also claims that police tried to pay off a fellow inmate to have him killed in return for early release. These allegations underpin his argument that justice has not been done and that his trial floundered on serious breaches. It’s unclear if these bombastic allegations will be enough to secure a new trial.
